To i have a law suit aganist the hospital?

About 3 months ago the I messed my hand up and I go to the hospital at 1 in the morning and the doctor asked me how I did and I told him..he asked me if I was drink and I told him I don't drink and you could give me a test if you want..doctor said no I don't have to..so they do x rays and tell me that its a minor contusion and brused..well its been past 3 months now and I feel pain everyday and my finger feels messed like I should of had surgery the first day I walked into the e.r I need help what you guys think
